Sexual Harassment Prevention Notice

Hamp Court Palace Taipei has established these regulations in accordance with the Sexual Harassment Prevention Act, the Enforcement Rules of the Sexual Harassment Prevention Act, and the Sexual Harassment Prevention Guidelines, in order to prevent sexual harassment, establish channels for filing complaints regarding sexual harassment incidents, and safeguard the rights and interests of the parties involved.

For the purposes of these regulations, “sexual harassment” refers to conduct, other than sexual assault crimes, that is related to sex or gender and is carried out against another person's will, under any of the following circumstances:
1. Conduct, whether explicit or implicit, or through discriminatory or insulting words or actions, or by any other means, that harms another person's dignity, creates an environment that causes fear, hostility, or offense, or improperly affects the person's work, education, training, services, programs, activities, or normal life.
2. Making a person's submission to or rejection of such conduct a condition for that person or another person to obtain, lose, or have reduced rights or interests relating to education, work, training, services, programs, or activities.
“Sexual harassment involving abuse of power” refers to sexual harassment committed by a person who uses their authority or opportunities to sexually harass an individual who is under their supervision, care, or guidance due to an educational, training, medical, public service, business, employment-seeking, or other similar relationship.
Where the Gender Equity Education Act or the Gender Equality in Employment Act provides specific provisions concerning the handling and prevention of sexual harassment based on the place where the incident occurs and the relationship between the parties involved, the applicable provisions of such laws shall prevail.

Forms of sexual harassment include, but are not limited to, any of the following:
1. Humiliating, disparaging, hostile, or harassing words or conduct.
2. Stalking, monitoring, or unwanted pursuit.
3. Voyeurism or surreptitious photography.
4. Exposure of private parts of the body.
5. Displaying, transmitting, or circulating obscene text, sounds, drawings, photographs, or video materials by telephone, facsimile, electronic communications, the Internet, or other devices.
6. Kissing, embracing, or touching another person's buttocks, breasts, or other private parts without consent when the person is unable to resist or refuse.
7. Other conduct similar to the foregoing.

To prevent sexual harassment, the Company shall take appropriate preventive, corrective, disciplinary, and other necessary measures, and shall properly protect the privacy of the parties involved.

With respect to public areas under the Company's management and places accessible to the public, the Company shall take the following measures to effectively prevent and actively address sexual harassment incidents:
1. Regularly review the spaces and facilities of public areas under the Company's management and places accessible to the public to prevent the occurrence of sexual harassment.
2. When the Company becomes aware of a sexual harassment incident occurring in such places, it shall take the following effective corrective and remedial measures:
1. Prioritize the safety of the victim, respect the victim's wishes, reduce opportunities for interaction between the parties, prevent or reduce the possibility of repeated sexual harassment by the perpetrator, and prevent retaliation.
2. Protect the privacy of the victim.
3. Assist the victim in filing a complaint and preserving relevant evidence.
4. Where necessary, assist in notifying the police to handle the incident.
5. Review the safety of the relevant premises.
6. Take any other measures deemed necessary.
3. If the Company becomes aware of a sexual harassment incident after it has occurred, it shall still take effective corrective and remedial measures and review the safety of the relevant premises again.

For cases subject to the Sexual Harassment Prevention Act, the victim may file a sexual harassment complaint depending on the status of the alleged perpetrator:
1. If, at the time the complaint is filed, the perpetrator belongs to a government agency (institution), military unit, or school, the complaint shall be filed with the relevant organization.
2. If, at the time the complaint is filed, the perpetrator is the head of a government agency (institution), a commanding officer of a military agency (institution) or military unit at or above the rank of colonel, the principal of a school, the highest person in charge of an institution, or an employer, the complaint shall be filed with the competent authority of the special municipality, county, or city where the relevant organization or employer is located.
3. If the perpetrator is unknown or does not fall under the preceding two categories, the complaint shall be filed with the police authority in the area where the sexual harassment incident occurred.

The Company shall regularly organize or encourage its personnel to participate in sexual harassment prevention education and training covering the following:
(1) Employees of the organization:
1. Knowledge and awareness of gender equality.
2. Basic concepts, laws, regulations, and prevention of sexual harassment.
3. Procedures and methods for filing sexual harassment complaints.
4. Other education related to sexual harassment prevention.
(2) Personnel responsible for handling sexual harassment incidents or personnel with managerial responsibilities:
1. Understanding the Gender Equity Education Act, the Gender Equality in Employment Act, and the Sexual Harassment Prevention Act, as well as the handling of related incidents.
2. Awareness and identification of differences in power relationships.
3. Effective corrective and remedial measures for sexual harassment incidents.
4. Assistance to victims and protection of their rights and interests.
5. Other education related to sexual harassment prevention.
Personnel participating in the above training shall be granted official leave and financial assistance by the Company.

The Company shall not subject any person who files a complaint, accusation, report, lawsuit, provides testimony or assistance, or otherwise participates in the complaint, investigation, inquiry, or adjudication process of a sexual harassment incident to any improper discriminatory treatment.
Improper discriminatory treatment as referred to above includes dismissal, demotion, reduction in salary, or infringement of any rights and interests to which the person is legally entitled.

The Company and any person shall keep confidential the name of the victim and any other information sufficient to identify the victim, unless otherwise provided by law. Such information shall not be publicly disclosed or revealed through the media or by any other means.
Such information includes the victim's photographs, images, drawings, voice, address, names of relatives or their relationship with the victim, school and class information, workplace and workplace name, or any other information that may directly or indirectly identify the victim.
9.
Where an employee or person in charge of the Company uses their position or duties to sexually harass another person, and the law requires appropriate measures to restore the victim's reputation, the Company shall provide appropriate assistance.

Upon becoming aware of a sexual harassment incident, the Company shall immediately assign personnel to take effective corrective and remedial measures and assist the victim in filing a complaint. Upon receiving a sexual harassment complaint, the Company shall designate responsible personnel to coordinate and handle the matter.
10.
These regulations shall apply mutatis mutandis to the offenses specified in Article 2, Paragraph 1 of the Sexual Assault Crime Prevention Act.
